1. Educational Purpose Only
CosmoPass (the "Service") is provided by Compassio Labs LLC, doing business as ("d/b/a") CosmoPass ("we", "us"). It is a study and exam-preparation tool for cosmetology state board examinations. All content is for general educational and informational purposes only.
2. No Guarantee of Results
Compassio Labs LLC does not guarantee that use of the Service will result in passing any examination, obtaining any license, or achieving any particular score. Exam results depend on many factors outside our control, including each user's own preparation, the official exam content, and changes in state requirements.
3. Not Official or Affiliated
CosmoPass is an independent study aid. It is not affiliated with, endorsed by, approved by, or sponsored by any state board of cosmetology or licensing authority, the National-Interstate Council of State Boards of Cosmetology (NIC), any testing vendor (including but not limited to PSI Services, Prov, Continental Testing Services, Professional Credential Services (PCS), Pearson VUE, and D.L. Roope Administrations), or any government agency. All trademarks and exam names belong to their respective owners and are used for identification only.
4. Accuracy of Content
We work to keep content accurate and up to date, but state laws, exam formats, fees, and requirements change frequently. We do not warrant that all content is complete, current, or error-free. CosmoPass is not responsible for changes in exam content, format, fees, or state requirements made by any board or testing vendor after these materials were prepared. Always verify official requirements with your state board before relying on them.
5. Not Professional or Legal Advice
Content in the Service does not constitute legal, professional, medical, or licensing advice, and CosmoPass makes no representation regarding employment, income, or career outcomes. For official guidance, consult your state board or a qualified professional.
6. Translations
CosmoPass may offer content in languages other than English. Any such non-English content is a translation provided for convenience only. If there is any conflict, the official English-language exam materials and state requirements control. We are not responsible for errors arising from translation.
7. Use at Your Own Risk
You use the Service at your own risk. To the fullest extent permitted by law, Compassio Labs LLC disclaims all warranties, express or implied, and shall not be liable for any loss or damage arising from your use of, or inability to use, the Service. This Disclaimer is governed by the Terms of Service, including its governing law and limitation of liability provisions.

TERMS OF SERVICE

1. Agreement
These Terms of Service ("Terms") are a legal agreement between you and Compassio Labs LLC, doing business as ("d/b/a") CosmoPass ("we", "us"), governing your use of CosmoPass and its website at https://getcosmopass.com (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
The Service is intended for people preparing for cosmetology licensing exams, who may include students enrolled in high-school or vocational programs. You must be at least 13 years old to use the Service. If you are under 18 (or under the age of majority where you live), you may use or purchase the Service only with the permission and involvement of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for any purchase. The Service is not intended for, and may not be used by, children under 13. Payment for the Service by a person under 18 will be treated as confirmation that a parent or legal guardian has authorized the purchase and agreed to these Terms.
3. License to Use
Subject to these Terms and payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the Service for your own individual exam preparation.
4. Access and Accounts
Access may be provided through login credentials or an account. You are responsible for keeping your credentials confidential and for all activity under your access. Do not share your access with others.
5. Prohibited Conduct
You agree not to: (a) share, resell, sublicense, or redistribute the Service or its content; (b) copy, scrape, or reproduce content for anything other than your personal study; (c) circumvent any access control or security measure; (d) use the Service unlawfully or to infringe others' rights.
6. Payment and Subscriptions
The Service may be offered as a one-time purchase and/or as a subscription. Fees, the billing cycle (if applicable), and what is included are shown at the point of purchase. How your payment is processed depends on where you buy. Purchases made inside the iPhone or iPad app are processed by Apple through the App Store; purchases made inside the Android app are processed by Google through Google Play; purchases made on our website are processed by our payment provider (e.g., Stripe). In every case we do not receive or store your full card details. A one-time purchase grants access as described at checkout. Where a subscription is offered, it renews automatically until cancelled, and you may cancel at any time to stop future renewals. Refunds are governed by our Refund Policy, which differs depending on where you purchased.
7. Intellectual Property
All content, design, and materials in the Service are owned by Compassio Labs LLC or its licensors and are protected by law. These Terms grant no ownership rights—only the limited license above.
8. Disclaimer and Limitation of Liability
The Service is provided "as is" without warranties of any kind. See our Disclaimer for details, including that we do not guarantee exam results. TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF COMPASSIO LABS LLC ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. This limitation does not apply to liability for fraud, willful misconduct, gross negligence, or violations of law that cannot be limited under applicable law. You acknowledge that this limitation is conspicuous and that you had a meaningful opportunity to review it before paying, and that it is a material part of the agreement between us.
9. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using the Service at any time.
10. Changes to Terms
We may update these Terms from time to time. If we make a material change, we will give you reasonable advance notice before it takes effect — by email to the address on your account, by a notice in the Service, or both — and we will update the "Last updated" date. Non-material changes take effect when posted. If you do not agree to a change, stop using the Service and, if you have a paid plan, you may cancel; your existing access will continue for the period you already paid for. A change does not apply to any dispute that arose before the change took effect.
11. Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. YOU MAY OPT OUT WITHIN 30 DAYS (SEE BELOW).
(a) Informal resolution first. Before starting arbitration, you and we agree to first try to resolve any dispute informally. Send a written notice describing the problem and the relief you seek to hello@getcosmopass.com. Both sides will try in good faith to resolve it for 30 days. Any statute of limitations is tolled from the date the notice is received until the end of that 30-day period. If it is not resolved, either party may begin arbitration.
(b) Agreement to arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms or to the CosmoPass exam-preparation service we provide to you (a "Dispute") that is not resolved informally will be settled by binding individual arbitration, and not in court. This Section applies only to Disputes concerning that service and these Terms; it does not extend to unrelated goods, services, or dealings. The Federal Arbitration Act governs this arbitration agreement.
(c) What this Section does not cover. Nothing in this Section prevents either party from: (i) bringing a qualifying claim in small claims court; (ii) seeking temporary, preliminary, or other provisional relief in any court of competent jurisdiction, including to stop actual or threatened infringement or misappropriation of intellectual property, and seeking such relief is not a waiver of the right to arbitrate; or (iii) reporting a matter to, or seeking relief from, any federal, state, or local government agency.
(d) Rules and forum. The arbitration will be administered by National Arbitration and Mediation (NAM) under its Comprehensive Dispute Resolution Rules and Procedures. If NAM is unavailable or declines to administer the arbitration, it will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules; if neither is available, a court of competent jurisdiction will appoint an administrator. The arbitration may be conducted by videoconference, by telephone, through written submissions, or in the county where you live, at your option. The arbitrator's decision is final and binding.
(e) Who decides what. The arbitrator decides all issues about the scope, interpretation, and enforceability of this arbitration agreement, except that a court, not the arbitrator, decides whether the class action waiver in (f) is enforceable.
(f) Class action waiver. You and we may bring claims against the other only individually, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator has no authority to hear class or representative claims or to consolidate more than one person's claims.
(g) 30-day right to opt out. You may opt out of this Section 11 (including the class action waiver) within 30 days of first accepting these Terms by emailing hello@getcosmopass.com with your name and a statement that you decline to arbitrate. Opting out does not affect any other part of these Terms.
(h) Fees. Arbitration filing, administration, and arbitrator fees are governed by the administrator's consumer rules; where those rules require us to bear certain fees, we will.
(i) Changes to this Section. If we change this Section 11, we will notify you. A change does not apply to any Dispute for which we received a written notice under (a) before the change took effect.
(j) California consumers. If you are a California consumer, nothing in these Terms requires you to arbitrate outside California a Dispute arising in California, or to arbitrate such a Dispute under the substantive law of any state other than California, and nothing in these Terms limits any right you have under California law, including California Civil Code section 1799.208. To the extent any provision of these Terms conflicts with that section, that provision does not apply to you.
(k) Severability; survival. If the class action waiver in (f) is found unenforceable as to a claim, that claim only is severed and brought in court, while all other claims proceed in arbitration. This Section 11 survives termination of these Terms.
(l) Your state's consumer rights. Nothing in these Terms waives or limits any right or remedy you have under the consumer protection laws of the state where you live that cannot be waived by agreement. If any provision of these Terms conflicts with such a right, that provision does not apply to you to the extent of the conflict.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules.
13. Notice for California Users
Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. PRIVACY POLICY

1. Who We Are
This Privacy Policy explains how Compassio Labs LLC, doing business as ("d/b/a") CosmoPass ("we"), collects and uses information when you use CosmoPass at https://getcosmopass.com (the "Service").
2. Information We Collect
- Information you provide: e.g., your email address and message if you contact us or submit feedback. - Account information: if you create an account, your email address and password (passwords are stored securely by our authentication provider), along with your study activity and progress. - Payment information: processed by our payment processor (e.g., Stripe). We receive confirmation and limited billing details but not your full card number. - Anonymous feedback: if you use in-app voting or polls (e.g., requesting future languages or states), we collect your selections without linking them to your identity. - Product waitlist: if you choose to join the waitlist for a separate app we are building (a professional hair-color calculator), we collect the email address you enter. This is optional, and no part of CosmoPass depends on it. - Usage data: e.g., pages viewed, features used, and device/browser type, collected automatically via server logs. - Cookies / local storage: used to remember your settings (such as selected state and language) and to keep you logged in. - No advertising or analytics cookies: We do not use third-party advertising or analytics cookies; any usage data is limited to the server logs described above.
3. How We Use Information
We use information to: operate and improve the Service; process payments; respond to your messages; ensure security and prevent abuse; and comply with legal obligations.
We use waitlist email addresses only to send a one-time notice when that separate app launches. We do not use them for any other marketing, and we do not share or sell them. You can unsubscribe at any time by emailing hello@getcosmopass.com.
4. Third-Party Services
We rely on third parties who process data on our behalf, which may include: payment processing (e.g., Stripe), database and account authentication (e.g., Supabase), hosting/CDN (e.g., Cloudflare), and feedback forms (e.g., Google Forms). Each has its own privacy policy.
5. Sharing
These providers act on our behalf as service providers and are not permitted to use your personal information for their own purposes. We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with the service providers above, or when required by law.
6. Data Retention
We keep information only as long as needed for the purposes above or as required by law, then delete or anonymize it.
Waitlist email addresses are kept until that app launches and the notice is sent, or until you ask us to remove them, whichever comes first.
7. Your Rights
Depending on where you live (e.g., California/CCPA), you may have rights to access, correct, or delete your personal information, and to opt out of certain uses. To request access to or deletion of your personal information, email hello@getcosmopass.com with the subject "Privacy Request." We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising these rights.
To be removed from the product waitlist at any time, email hello@getcosmopass.com. Deleting your CosmoPass account also removes any waitlist entry that uses the same email address.
8. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. Users under 18 should use the Service only with a parent or guardian's involvement (see our Terms of Service). If we learn we have collected personal information from a child under 13 without the required consent, we will delete it.
9. Changes
We may update this Policy. Material changes will be posted here with a new "Last updated" date.

REFUND POLICY

1. Digital Product
CosmoPass, provided by Compassio Labs LLC (d/b/a CosmoPass), is a digital study product delivered electronically. Access is typically granted immediately after purchase.
2. Where You Bought Matters
How a refund is handled depends on where you made the purchase. We can only refund purchases we actually processed.
(a) Purchased inside the iPhone or iPad app (Apple App Store)
Apple processes and holds these payments, not us. Only Apple can issue a refund for these purchases. Request one at reportaproblem.apple.com or through Apple Support.
Whether a refund is given is entirely Apple's decision, made under Apple's own terms. Apple does not publish a fixed deadline for these requests, and eligibility may vary by country or region. We cannot approve, deny, reverse, or override Apple's decision, and if Apple declines a refund, there is nothing we can do about it — please take it up with Apple.
Apple does not share your purchase details with us, so we cannot access your Apple Account, purchase history, or receipts.
What we will do: if you contact us first, we will point you to Apple and, where Apple asks us for information about your purchase, we will respond promptly and accurately.
Nothing in this section limits any right you have under applicable consumer protection law.
(b) Purchased inside the Android app (Google Play)
Google processes these payments. Within 48 hours of purchase you may be able to get a refund directly from Google: open the Google Play Store app, go to your order history, find the transaction, select "Report a Problem" and submit your request.
After 48 hours, Google directs you to the developer. Contact us at hello@getcosmopass.com and, where eligible under our refund window below, we can issue the refund through Google Play Console.
(c) Purchased on our website (getcosmopass.com)
We process these payments through our payment provider. Email hello@getcosmopass.com from the address used at purchase, or use the refund option in your account. Approved refunds are returned to your original payment method.
3. Refund Window
For purchases made on our website, you may request a refund within 7 days of purchase if you are not satisfied. After 7 days, those purchases are non-refundable except where required by law.
This 7-day window applies to purchases we process: purchases made on our website, and Google Play purchases that Google refers back to us after its own 48-hour window. Purchases made through the Apple App Store are governed entirely by Apple's own policies, as described in section 2(a), which we do not control.
4. Exceptions
We may decline refunds where there is evidence of abuse, such as sharing or redistributing content, or excessive/duplicate refund requests (for example, requesting a refund on more than one purchase within a 12-month period). This applies to refunds we process; Apple and Google apply their own criteria.
5. What Happens to Your Access
If a refund is issued through any channel, access to the paid content ends. Your account and study progress are not deleted by a refund; you can continue using the free portion, or delete your account at any time.
6. Subscriptions
If the Service is offered as a subscription, you may cancel at any time to stop future renewals. Cancellation stops the next charge; it does not automatically refund the current period unless within the refund window above. Subscriptions purchased through the App Store or Google Play must be cancelled in your Apple or Google account settings.
7. Chargebacks
We encourage you to contact us (or Apple/Google, depending on where you purchased) before initiating a chargeback with your bank, since most issues can be resolved directly and faster.

ACCOUNT DELETION

App: CosmoPass — Cosmetology State Board 2026 Developer: Compassio Labs LLC (d/b/a CosmoPass)
1. Delete your account from inside the app
You can delete your account yourself at any time. No email or approval is required.
1. Open CosmoPass and sign in. 2. Tap the account icon. 3. Tap Delete account. 4. Confirm twice. Deletion happens immediately.
2. If you can no longer sign in
If you have uninstalled the app or cannot access your account, email hello@getcosmopass.com from the email address registered to the account, with the subject line Delete My Account. We will verify and complete the deletion within 30 days.
3. What is deleted
- Your account and login credentials (email address and password) - Device records used to enforce the two-device limit - Your paid unlock status (entitlement) - Your email address if it was added to any waiting list
Deletion is immediate and permanent. It cannot be undone, and a deleted account cannot be restored.
4. What is kept, and for how long
- Transaction and payment records. These are held by our payment processor (Stripe) and in our accounting records, and are retained for up to 7 years as required by United States tax and accounting law. They are not used to identify you within the app after deletion. - Anonymized or aggregated data that can no longer identify you.
5. Study progress and cloud sync
Your study progress, flashcard history, mock exam scores and wrong-answer notebook are stored on your device and synced to your account so you can continue on another device. They are deleted together with your account, or immediately when you use Clear study history inside the app — which clears both the copy on your device and the copy synced to your account. You can clear them without deleting your account.
6. Deletion and refunds
Deleting your account does not automatically issue a refund, and requesting a refund does not automatically delete your account. See the Refund Policy for refund terms.
